Kentucky DUI Law DWI School Arrest

First offense Kentucky DUI Cases are punished as follows:

Lookback period is now 5 years from DUI date of arrest to date of prior DWI arrest!

• Fine: $200.00-$500.00 (plus statutory service fee of $250.00 counseling and other miscellaneous costs.)  Total of about 500.0 more than the fine alone is added as service fees and required counseling.   Expect huge increases in insurance costs that will  cost thousands over then next five years as you drive.  
• Jail: 48 hours to 30 days after DUI arrest. Under Kentucky law for a first DWI offender, either a fine or jail must be imposed.
• License Suspension: license suspension between 30 and 120 days. A hardship license is available if the suspension is more than 30 days. Drivers under 21 will be suspended for 30 days to six months and can have a hardship license. After the license suspension and completion of alcohol treatment, drivers may be reinstated.
• Alcohol and Drug Assessment and Treatment: Within ninety days at your additional cost.

Aggravating Factors

After October 1, 2000, Kentucky DUI law establishes a list of six aggravating factors, which, double the mandatory minimum jail sentence.

The aggravating factors are:

1. Operating a motor vehicle in excess of thirty (30) miles per hour above the speed limit while DWI;
2. Operating a motor vehicle in the wrong direction on a limited access highway while DUI;
3. Operating a motor vehicle that causes an accident resulting in death or serious physical injury While DUI;
4. Operating a motor vehicle while the alcohol concentration in the operator's blood or breath is 0.18 or more as measured by a test or tests of a sample of the operator's blood or breath taken within two (2) hours of cessation of operation of the motor vehicle While DWI;
5. Refusing to submit to any test of one's blood, breath or urine requested by an officer having reasonable grounds to believe the person was operating or in physical control of a motor vehicle in violation of the DUI laws;
6. Operating a motor vehicle that is transporting a passenger under the age of twelve (12) years old while DWI.

Only a "not guilty" verdict or other non-DUI disposition of the case will prevent these consequences.  This puts a premium on winning your DUI case, or obtaining a non-DUI disposition.
