Kentucky Personal Injury Automobiles Accidents Insurance Claims

Certain  expenses are called special damages.  Automobile or Property damages and lost wages are called general damages.  The older system of processing automobile and personal injury claims would have an accident adjuster consider your personal automobile injury case and the skills of your attorney and normally offer 3 times the special damages plus the general damages and lost wages.  Personal Injury Attorneys will often attempt to settle the case for 4 or 5 times the medical costs or more when the damages are particularly painful disfiguring life threatening or severe.  The 3 times specials formula simply does not apply in some cases like disfigurement cases.  Now adjusters put accident information about the claim and accident software gives a valuation range of the expected personal injury recovery.  They use a simple number of factors like the type of accident, type of injuries and medical costs to compute your recovery.

Automobile insurance companies will often purposely low-ball the value of your case by inputting that you have only minor damages in some automobile accident cases.   They also wont tell you how they are calculating the value of your accident claim or what it is really worth.  Accident Insurance companies and even their attorneys have been known to destroy documents and evidence to manipulate claims and lower what they pay you.  These people simply are not your "good neighbors" and when you put your trust in them don't think, "you are in good hands" for one moment.   Adjusters and insurance attorneys are often paid bonuses on what they didn't pay to you.

Because the adjuster is using software and doesn't personally investigate the accident he often doesn't have the facts about how serious your case is.  He is negotiating from a chart and doesn't know what the facts are and this is only a starting point.  He can overpay or underpay claims because he lacks any personal knowledge.  This is why it is important to have an attorney that can properly put together your claim for what your damages are worth.  Using the 3 times medicals formula could value the broken are injury equally with a face that is scared for life.  If you want to know what the maximum value of your claim is you might want to check law journals and sources like Jury Verdict Review 973-376-9002 which list the maximum jury verdicts.

Relying on the automobile insurance company to tell you the truth about the value of your personal injury insurance claim is foolish.  It is just not in their best interests to honestly tell you what your personal injury claim is worth.  Time after time they have proven that they will force you to accept a lesser amount than what your personal injury accident case is worth.   Each accident case is unique but case studies have shown that the average person that settles an accident case on his own without an attorney settles for less than 50%.   In valuing your accident case seek a competent Accident Personal Injury Attorney
